General Questions
When the buyer and farmer agree to arrange the shipment between themselves and not involve Agribit, shipping and delivery terms are agreed upon directly between the buyer and seller. The seller remains responsible for preparing goods for shipment and ensuring compliance with applicable laws. Agribit does not take ownership or physical possession of goods. Where available, sellers may choose to arrange shipping through third-party logistics providers accessible via the platform. If however, the buyer and farmer agree to involve Agribit for quality control, then a small service fee will be charged to the farmer for which Agribit will pick up the product listing(s) from the farmer’s location directly, perform quality control checks, and if a passing grade is given, then the shipment will be shipped out through the logistics chain of Agribit.
No. Agribit does not guarantee delivery timelines, product quality, quantity, condition, or regulatory compliance of any goods listed or transacted on the platform. All agricultural products are listed, produced, packaged, and supplied by independent sellers, and sellers remain responsible for fulfilling the terms of their transactions, including compliance with applicable agricultural, food safety, export, and labeling regulations. In some cases, buyers and farmers may jointly agree to use optional services facilitated through Agribit, such as third-party quality inspection, handling, or logistics coordination. These services are provided to support transparency and process efficiency and do not constitute a guarantee of product quality, delivery outcomes, or regulatory compliance by Agribit. Agribit provides the digital infrastructure for listings, communication, payment facilitation, recordkeeping, and dispute support, but is not a party to sales contracts and does not assume ownership or liability for goods. Buyers are encouraged to review listings carefully, communicate directly with sellers, and conduct appropriate due diligence before completing transactions. Agricultural production and logistics involve inherent risks, and outcomes may vary due to factors beyond Agribit’s control.
Cancellation rights depend on the agreement and crop stage. Custom or pre-harvest orders may not be cancellable. Order changes depend on crop growth stage or shipping status. Policies are outlined in each transaction and are governed by the escrow system.
Agribit facilitates payments and implements safeguards to help ensure agreed payments are upheld. Funds are secured through Agribit Credits and escrow-style mechanisms before transactions proceed. However, Agribit does not act as a bank, insurer, or financial guarantor, and final liability remains with the contracting parties.
If a dispute arises between a buyer and a seller, Agribit provides a structured dispute resolution process designed to help the parties communicate, clarify issues, and seek a resolution. Through this process, Agribit may review relevant platform records—such as transaction details, messages exchanged through the platform, payment status, and agreed milestones—and may facilitate communication or mediation between the parties. This process is intended to support fair resolution based on the agreed transaction terms. Agribit does not act as a court, arbitrator, or legal authority and does not make binding legal determinations. Final responsibility, liability, and any legal remedies remain with the contracting parties.
If a buyer fails to perform according to the agreed transaction terms, for example, by failing to confirm milestones, refusing delivery without valid cause, or otherwise breaching the agreement—the farmer may initiate a dispute through the Agribit platform. Agribit may assist by reviewing platform records, facilitating communication, and applying applicable platform rules, including holding or releasing funds in accordance with the transaction terms and dispute process. Where appropriate, Agribit may take administrative actions on the platform, such as account warnings, restrictions, or suspension. Agribit does not adjudicate legal claims or provide legal remedies. Farmers retain the right to pursue external legal action where permitted by law, and Agribit does not assume liability for buyer non-performance.
Farmers using the Agribit platform are expected to act professionally, transparently, and in good faith when engaging with buyers and other users. This includes, but is not limited to: Providing accurate and complete listings Farmers must ensure that product descriptions, quantities, pricing, crop stages, certifications, and availability are accurate, current, and not misleading. Communicating promptly and clearly Farmers should respond to buyer inquiries, transaction updates, and platform messages in a timely and professional manner, especially when issues or delays arise. Acting in good faith Farmers are expected to honor agreed terms, make reasonable efforts to fulfill commitments, and notify buyers promptly if circumstances arise that may affect production, delivery, or quality. Complying with platform policies and applicable laws Farmers must follow Agribit’s Terms of Service, platform rules, and any applicable local, national, and international laws governing agricultural production, trade, and food safety. Failure to meet these expectations may result in platform actions such as listing removal, account restrictions, suspension, or other measures as outlined in Agribit’s policies.
Each party to a transaction is responsible for complying with the laws and regulations applicable to their role and jurisdiction. Farmers and sellers are responsible for ensuring that agricultural goods are produced, handled, labeled, and prepared in accordance with applicable agricultural, food safety, export, and labeling regulations. Buyers are responsible for complying with applicable import, customs, and use requirements in their destination jurisdiction. Agribit provides a digital platform to facilitate transactions and may offer tools, documentation support, or access to third-party services where available, but Agribit does not independently verify regulatory compliance and does not assume responsibility for ensuring compliance on behalf of users.
To the maximum extent permitted by applicable law, Agribit disclaims liability for losses, damages, delays, or disputes arising out of or related to the use of the platform or transactions between users. Agribit acts solely as a technology platform that facilitates introductions, communication, and payment processes between independent buyers and sellers. Agribit is not a party to contracts formed between users and does not assume responsibility for the actions, omissions, or performance of any user. This includes, but is not limited to, losses or disputes related to: 1. Product quality, quantity, or condition 2. Delivery delays or failures 3. Crop yield, production outcomes, or force majeure events 4. Regulatory or customs issues 5. Financial losses or missed opportunities Users acknowledge that agricultural and commercial transactions involve inherent risks and agree that they engage in transactions on the platform at their own discretion and risk. Nothing in this section limits Agribit’s liability where such limitation is prohibited by applicable law.
